Tarihsel süreç içerisinde, insanların sırf insan oldukları için bazı haklara sahip oldukları ve bu hakların korunması gerektiği tüm Dünya'da kabul görmüş bir gerçektir. İşte bu hakları koruma noktasında devlet kavramı ön plana çıkmıştır. Devletin asli amaçlarından biri "temel hak ve özgürlükleri" sosyal hukuk devleti ve adalet ilkeleri çerçevesinde; sosyal, siyasal ve ekonomik engelleri ortadan kaldıracak şekilde belirlemektir. Dolayısıyla bu özgürlüklerin öncelikle kamu gücü tarafından ihlal edilmesini önlemek ve oluşabilecek temel hak ve özgürlük ihlallerini ortadan kaldırmak amacıyla Anayasa Mahkemesi'ne bireysel başvuru yolu uygulaması geliştirilmiştir.

In the historical process, it is a worldwide accepted fact that people have certain rights because they are human and that these rights must be protected. This is where the concept of protection of the rights of the state has come to the forefront. One of the primary objectives of the state is to determine the "fundamental rights and freedoms" in the framework of the social law state and the principles of justice; in a way that eliminates social, political and economic obstacles. Therefore, the application of the individual application to the Constitutional Court has been developed in order to prevent the violation of these freedoms primarily by the public power and to eliminate the possible violations of fundamental rights and freedoms.
